NEW TRAFFIC RULES STARTING OCTOBER 1ST
On October 1, 2026, Royal Decree 518/2026 (dated June 24) comes into effect. It amends the General Traffic Regulations and introduces significant updates to improve road safety and provide special protection for the most vulnerable road users.
The Marbella Local Police have now provided a simple update of the key changes affecting Personal Mobility Vehicles (PMVs), motorcycles, mopeds, and vehicle drivers.
PERSONAL MOBILITY VEHICLES (PMVs / Electric Scooters)
- The minimum age to operate a PMV is now 15.
- Wearing a protective helmet will be mandatory.
- Wearing a reflective vest will also be mandatory at night or in conditions of poor visibility.
- Professionals using a PMV for work must wear a reflective vest at all times.
MOTORCYCLES AND MOPEDS
- Motorcycle and moped riders and passengers must wear protective gloves when traveling on interurban roads.
- Additionally, wearing closed-toe footwear will be mandatory on all types of roads. So no more flip flops or sandals!
- In certain traffic congestion situations and where duly signposted, motorcycles may ride on the right-hand shoulder, provided they do not exceed 30 km/h.
- Professional riders using motorcycles for work must wear a **reflective vest at all times**.
- Furthermore, protective helmets used by moped riders must be approved/certified.
VEHICLE DRIVERS
- One key new feature is the creation of the so-called “emergency lane.” When traffic congestion causes vehicles to move at a walking pace or come to a standstill, drivers must pull over to the sides to leave a clear central space for police, fire, ambulance, and other emergency service vehicles to pass.
- Protection for cyclists is also being strengthened. Motor vehicle drivers must maintain a minimum distance of 5 meters from cyclists ahead of them when traveling in the same lane.
- Additionally, the reform introduces new measures to improve safety in urban areas and provide special protection for pedestrians, cyclists, motorcyclists, and users of personal mobility vehicles (PMVs).
**IMPORTANT**
Some of these measures have specific implementation dates. For example, certain provisions regarding PMV lighting and motorcycle helmet certification will apply starting October 1, 2027.
